PLEASE READ THESE TERMS AND CONDITIONS OF SALE CAREFULLY. THEY GOVERN YOUR PURCHASE OF OUR PRODUCTS AND CONTAIN VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.
ACCEPTANCE OF THESE TERMS
You (“Customer”) may place orders for Products with Par Social, LLC (“Company,” “we,” “our”) via our website www.parsocialgolf.com (our “Website”), “Products” collectively means any and all items being sold by Company to Customer. By placing an order for our Products, you consent to these Terms and conditions of sale (“Terms”) and acknowledge that we will only furnish the Products subject to these Terms. Unless expressly agreed to in writing by Company, any term or condition in any order or other form or correspondence that purports to add to or is in any way inconsistent with these Terms shall be inapplicable and of no force and effect whatsoever. Company’s right to require strict observance and performance of each of these Terms shall not be affected by concurrent waiver of any other of these Terms or by any previous course of dealing.
ORDERS
You agree that your order is an offer to buy, under these Terms, all products and services listed in your order. All orders must be accepted by us or we will not be obligated to sell the products or services to you. We may choose not to accept orders at our sole discretion, even after we send you a confirmation email with your order number and details of the items you have ordered. All orders are subject to the availability of the ordered Product(s). Company may cancel any order due to Product discontinuation, availability or price change or correction. Customer will be notified of any cancellation.
PRICE
All prices, discounts, and promotions posted on this Website are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Price increases will only apply to orders placed after such changes. Posted prices do not include taxes or charges for shipping and handling. All such taxes and charges will be added to your merchandise total, and will be itemized in your shopping cart and in your order confirmation email. We strive to display accurate price information, however we may, on occasion, make inadvertent typographical errors, inaccuracies or omissions related to pricing and availability. We reserve the right to correct any errors, inaccuracies, or omissions at any time and to cancel any orders arising from such occurrences.
We may offer from time to time promotions on the Site that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
TAXES
The prices quoted for the Products sold hereunder do not include any foreign, federal, state or local sales, use, value-added, excise, gross receipts or any similar transaction or consumption taxes, tariffs, duties or other charges imposed on or measured by the use or sale of Products (collectively, “Taxes”). Customer shall pay any Taxes, except where Company has previously withheld any such Taxes from the amount remitted to Company by Customer.
PAYMENT
Terms of payment are within our sole discretion and, unless otherwise agreed by us in writing, payment must be received by us before our acceptance of an order. We accept Visa, Mastercard, American Express, Discover, and Apple Pay for all purchases. You represent and warrant that (i) the credit card information you supply to us is true, correct and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any, regardless of the amount
DELIVERY AND RISK OF LOSS
We will arrange for shipment of the Products to you. Please check the individual Product page for specific delivery options. You will pay all shipping and handling charges specified during the ordering process. Shipping and handling charges are reimbursement for the costs we incur in the processing, handling, packing, shipping, and delivery of your order.
Title and risk of loss pass to you upon our transfer of the products to the carrier/delivery. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments. Company will use commercially reasonable efforts to fill Customer’s orders within the time stated but in no event shall Company be liable for any damages associated with Company’s inability to meet any such timeframes or deadlines.
RETURNS
- Domestic returns are eligible for a refund if postmarked within 14 days of delivery. Items returned after 14 days will not be accepted.
- There will be a $7.00 per return package fee that will be deducted from your refund for the pre-paid return label.
- Full-priced items may be returned for refund to the original method of payment.
- Items purchased on sale are FINAL SALE and therefore not eligible for return or exchange. No exceptions. Additionally, no promotion codes can be applied to the sale items. Par Social does not extend price adjustments or partial refunds on orders made prior to the promotion.
- Orders are processed pending item availability and credit card verification. Customer service will contact you via email if an item has been backordered or if there are any other issues with your order.
- We are unable to offer price adjustments on any purchases.
- Merchandise must be returned in its original condition, unwashed, unworn, with tags in place.
- All bodysuits, hats and gloves are FINAL SALE
- If you receive an item which is damaged, you must contact customer service within 48 hours of delivery.
- Par Social reserves the right to deny any return if the merchandise returned does not comply with our Returns policy.
- Once we have received your package, your refund will be processed within 7-10 business days. Please note that your banking institution may require additional days to process and post this transaction to your account once they have received the information from us (typically 3-5 business days). Original shipping charges are non-refundable.
- We are unable to accommodate direct exchanges. If you would like to exchange, please return your order and place a new one.
- To make a return, please contact customerservice@parsocialgolf.com and provide your order number to request a return label.
PRODUCT CHANGES
Company may make any change in the design of or specifications for, or in the way it manufactures or produces any Product if such changes are necessary or desirable to improve the safety or performance of such Product. Further, Company may furnish suitable substitute Products or components for Products or components which are unobtainable by Company because of any priorities, rules, regulations or the like established by governmental authorities or agencies, or due to price changes or the non-availability of materials or components from suppliers. Customer may not make any changes in the designs or specifications for the Products unless Company approves of such changes in writing, in which event Company may impose additional charges to implement such changes.
LIMITED WARRANTY
Subject to the following limitations, terms, and conditions, Company warrants to the original purchaser of each Product, that such Products when purchased new, are free of defects in materials and workmanship. This limited warranty may be exercised for a period of up to one year from the date of purchase. This limited warranty does not apply to normal wear and tear, nor to claimed defects, malfunctions or failures that result from abuse, neglect, improper assembly, improper maintenance, alteration, collision, crash, or misuse.
EXCEPT AS EXPRESSLY SET FORTH ABOVE, COMPANY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. COMPANY’S RESPONSIBILITY FOR WARRANTY CLAIMS IS LIMITED TO, AT COMPANY’S SOLE DISCRETION, REIMBURSEMENT OF THE ORIGINAL PURCHASE PRICE OR REPLACEMENT OF THE PRODUCT WITH THE SAME OR SIMILAR PRODUCT. NOTWITHSTANDING ANYTHING IN THESE TERMS TO THE CONTRARY, COMPANY SHALL NOT BE RESPONSIBLE OR HELD LIABLE FOR PUNITIVE, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION, LIABILITY FOR LOSS OF USE, LOSS OF PROFITS, LOSS OF PRODUCT OR BUSINESS INTERRUPTION HOWEVER THE SAME MAY BE CAUSED, INCLUDING FAULT OR NEGLIGENCE OF COMPANY.
In order to exercise rights under this limited warranty, Customer must return the affected Product to Company with proof of purchase (original invoice or credit card statement). To make a return, please contact customerservice@parsocialgolf.com and provide your order number to request a return label. Company reserves the right to modify this limited warranty at any time, in its sole discretion.
NOT FOR RESALE
Customer agrees to comply with all applicable laws and regulations of the various states and of the United States. Customer agrees and represents that he or she is buying the Product(s) for his or her own use and not for resale.
RESERVATION
Company reserves the right to refuse to sell Products to anyone for any reason, in its sole discretion.
GOVERNING LAW AND JURISDICTION
These Terms of Sale and any dispute or claim arising out of, or related to, them, their subject matter or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of the State of Illinois without giving effect to any choice or conflict of law provision or rule (whether of the State of Illinois or any other jurisdiction).
Any legal suit, action or proceeding arising out of, or related to, these Terms of Sale or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Illinois in each case located in the City of Oak Brook and County of DuPage, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms of Sale in your country of residence or any other relevant country. You agree to waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
WAIVER AND SEVERABILITY
No waiver of these Terms of Sale by the Company shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Sale shall not constitute a waiver of such right or provision.
If any provision of these Terms of Sale is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Sale will continue in full force and effect.
ENTIRE AGREEMENT
The Terms of Sale and our Privacy Policy and Terms of Service constitute the sole and entire agreement between you and Par Social, LLC with respect to any sales of Products through the Website and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Products and the Website.
EXCLUSIVITY
The parties’ rights, liabilities, responsibilities and remedies with respect to the Products shall be exclusively those expressly set forth in these Terms. The waivers, releases, limitations on liability and on remedies expressed in these Terms shall apply even in the event of the default, negligence, breach of contract, strict liability, of the party released or whose liability is limited and shall extend to their directors, officers, and employees.
